1. Introduction and Agreement

By downloading, installing, registering for, using, or accessing the Sheerr Weather App (“App”), you agree to be bound by these Terms of Use (“Terms”). This is a legal agreement between you (“you,” “your,” or “User”) and Sheerr Weather (“Company,” “we,” “us,” or “our”). If you do not agree to these Terms, do not use the App.

You affirm that you are at least 18 years old or have parental/legal guardian consent to use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App on your compatible mobile device for personal, non-commercial use, subject to these Terms.

3. User Responsibilities and Acceptable Use

3.1 Prohibited Activities

You may not:

•  Engage in any unlawful activity through the App.

•  Interfere with or disrupt the App’s functionality, servers, or networks.

•  Attempt unauthorized access to other users' data or our systems.

•  Transmit harmful code (viruses, malware, etc.).

•  Use the App for spamming or unsolicited communications.

•  Infringe copyright, trademarks, or other intellectual property rights.

•  Modify, reproduce, or distribute App content without permission.

3.2 Intellectual Property

All App content -- including text, graphics, logos, trademarks, and software -- is owned or licensed by the Company and protected by applicable intellectual property laws. You may only use this content as expressly permitted in these Terms.

All weather forecasts, reports, and related data generated by the App are the property of Sheerr Weather or its licensors and are provided for personal, non-commercial use only. Any redistribution, resale, or republication is strictly prohibited without our express written consent.

3.3 Data Collection and Privacy

We collect data such as location, usage statistics, and device information to improve services. Our Privacy Policy (available through sheerrweather.ca/privacypolicy) explains what we collect, how it is used, and how it is protected. By using the App, you consent to that collection and processing as described there.

Your use of the App may also be subject to the terms and conditions of third-party platforms such as Apple App Store or Google Play, which are not under our control.

3.4 Content Submission (User-Generated Content)

If you submit User Content (e.g., photos, videos, comments), you must own or have rights to that content and the content must comply with applicable laws.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, sublicensable license to use, reproduce, distribute, modify, display, and perform that content in connection with the App and Company business, including promotion. You will not receive any compensation.

We reserve the right to monitor, edit, remove, or refuse any User Content at our sole discretion.

3.5 Geographic Restrictions

The App and its services are intended for users in Canada. We do not guarantee service availability elsewhere and may restrict access based on your location.

4. Termination and Account Management

• We may suspend or terminate your account and access to the App at any time for violations of these Terms or for any activity that we deem harmful.

• You may request account deletion by contacting us at privacy@sheerrweather.ca. Following deletion, copies of User Content and account data may remain archived per legal obligations or for record-keeping.

5. Disclaimers and Limitations of Liability

5.1 Warranty Disclaimer

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES -- EXPRESS OR IMPLIED -- including MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

5.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHEERR WEATHER IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL) ARISING FROM YOUR USE OR INABILITY TO USE THE APP.

5.3 Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from or related to your violation of these Terms or misuse of the App.

6. Other Important Clauses

6.1 Governing Law and Forum

These Terms are governed by the laws of the province of Newfoundland and Labrador, Canada and the laws of Canada applicable in the province, without regard to conflicts of law principles. Any and all claims must be brought in the courts of Newfoundland and Labrador or Canadian courts situate in the province.

6.2 Changes to Terms

We may update these Terms at any time. If changes are material, we will notify you (e.g. via in-app notice). Your continued use after changes means you accept the updated Terms.

6.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

6.4 Entire Agreement

These Terms (along with the Privacy Policy and any other referenced policies) constitute the entire agreement between you and the Company regarding the App, superseding all prior agreements.
