Online Privacy Notice

This Privacy Notice applies to personal information Sheerr Weather, Torbay, Newfoundland and Labrador, Canada, collects through this website (sheerrweather.ca) and our mobile apps. Below are highlights of our personal information handling practices.

Privacy Notice Highlights

1. Information We Collect. We collect your information from the following sources:

  • (a) information you give us when you fill out forms, such as during online registration, customer service inquiries and surveys;

  • (b) information from other sources, such as affiliates of our company with which you have purchased goods and services and companies that help us to update our records; and

  • (c) information that we collect automatically when you visit our website, such as information about your browser settings and other information collected through cookies.

2. Why We Collect and Use Your Information.

  • (a) We use your information to provide products and services and to manage our business operations. For example, we use your information in order to answer your inquiries, authenticate you when you sign into online services, prevent loss and fraud, and analyze our business operations and website performance.

  • (b) We use your information for marketing and promotional purposes, including with our promotional partners.

  • (c) We combine all the information we collect other than information relating to your browsing history in order to understand your interests better and to analyze customer trends.

3. When We Share Your Information

  • (a) We share information with our affiliates who may be outside of Canada and may be subject to laws that are different from those in Canada. These affiliates may combine the information we provide with other information that they have collected from you.

  • (b) We use third parties to assist us in our operations, including our direct advertising and marketing services. We may also share your information with these third parties in order to provide services to you such as shipping.

4. Your Choices

  • (a) When you use our online services or those of one of our affiliates and you create an account, we will create an account profile for you. We will use this account profile to select certain goods and services for you to view during your online experience. This means that you may see a highly customized inventory. If you would prefer not to have a customized experience, you may use our “guest checkout” option instead of creating an account. Your experience on our website will still be customized based on your browsing history, but we will not use your purchase history to customize the inventory we show you.

  • (b) The Preference Center allows you to change your communication preferences with respect to e-mail newsletters and notifications of special offers and products.

  • (c) You may also close your account if you want to withdraw your consent from our further use of your information. We may, however, retain information about your previous transactions for audit purposes, to ensure the integrity of our data and to fulfill legal requirements.

  • (d) You should be aware that withdrawing consent for location tracking means you will no longer receive location-based weather forecasts or alerts. Withdrawing consent for user-generated content (photos, videos, comments) will prevent further processing of your submissions, and we may delete existing content unless retention is required by law or as described in our Terms.

  • (e) Withdrawing consent will apply only to future data collection and use; it will not affect the lawfulness of processing undertaken before the withdrawal.

  • (f) After withdrawal, we may still retain or process personal information if needed to comply with legal obligations, resolve disputes, or meet other regulatory requirements.

Detailed Privacy Notice

1. About Us. This website sheerrweather.ca is operated by Sheerr Weather. We are located in Torbay, Newfoundland and Labrador, Canada.

We have appointed a Chief Privacy Officer who is accountable for our personal information handling practices. Our Chief Privacy Officer is Eddie Sheerr. If you have a question or complaint about our personal information handling practices, please contact us at privacy@sheerrweather.ca.

In this Privacy Notice, the terms “we”, “our” and “us” mean Sheerr Weather.

2. Effective Date and Scope. This Privacy Notice is effective as of July 4, 2025.This Privacy Notice governs our practices with respect to personal information we collect through the following websites and online applications: sheerrweather.ca and the Sheerr Weather Mobile App available on the Apple App Store and Google Play.

3. What Personal Information Do We Collect? Personal information is information that identifies you or could be combined by us or our service providers and affiliates with other information to identify you. This information includes your personal e-mail address, your home address, your home telephone number, your personal cellphone number, your image, and may include your age, your income and other similar information when associated with you. Personal information may also be information containing details as to whether you have opened our promotional e-mails or how you have used our website, if we can associate that personal information with you. If you are a business customer or prospective business customer, personal information does not include your title, business address and business telephone number when we use that information to contact you in your business capacity.

We collect personal information from you when you create an account, make a purchase, enter a contest or promotion, communicate with us using our web forms to make a request or ask a question, submit a product review, take a survey or otherwise submit personal information to us with your communication. For example, we will request credit card and other identifying information to process a credit card transaction when you purchase a product or service through our website. We will also ask you for contact information in order to ship your product to you or the recipient that you designate.

We receive personal information about you from other sources. For example, we will receive information from credit card processors regarding whether the credit card details you gave us have been accepted or declined. We will receive information from shipping companies regarding whether the product we shipped was delivered or was undeliverable.

We may also acquire information about you from other promotional or marketing companies with whom you shared your information and whom you have allowed to provide information to us.

4. User Generated Content (“UGC”): When you voluntarily submit content -- such as photos, videos, or comments -- through our website or mobile app, we may:

  • (a) Use and disclose your submissions to showcase weather updates, promote community features, and support our content creation in accordance with our Terms of Use.

  • (b) Retain your content for as long as necessary to fulfill these purposes, unless you request deletion or withdrawal of consent, or as required under legal obligations.

By posting UGC, you represent that you own or have permission to use the content, and you grant us a non‐exclusive, worldwide, royalty‐free right to reproduce, display, and distribute it -- without compensation -- consistent with your permissions under our Terms.

5. How Do We Use Your Personal Information? We use your information to provide products and services and to manage our business operations. Some examples include:

  • (a) to register your account;

  • (b) to authenticate you when you log into your account;

  • (c) to fulfill your requests for products and services;

  • (d) to communicate with you about your requests;

  • (e) to administer contests and promotions that you participate in;

  • (f) to recommend or to offer you other products and services based on your inferred interests;

  • (g) to post your product and service reviews;

  • (h) to communicate with you regarding customer service issues and any product recalls or warranty service; and

  • (i) to protect the security or integrity of our websites and our business.

Your personal data is retained for no longer than necessary to fulfill the stated purposes or comply with legal obligations -- typically ranging from 1 to 7 years for account and usage data. We maintain a records retention and destruction program to destroy information when it is no longer needed or required.

6. Personalized Experience and Web Analytics. We also automatically collect information when you visit our website in order to customize your experience. For example, we collect information about what site referred you to our website, your browser type, operating system type and version, language, and your Internet Protocol (“IP”) address. We also collect information about how you browse through our website, including logging the pages you visit and the amount of time you spend on certain pages. We use this information for a number of technical purposes to ensure that our pages load correctly in your browser, as well as to personalize our offers to you. We also use this information to improve our website. For example:

  • (a) we use IP addresses to correct pages for your geographical location;

  • (b) we log the frequency of visits to certain pages on our website and how visitors navigate through our website in order to detect problems, improve our website and learn about what products and services are of interest to our customers;

  • (c) we use information about products that you have clicked on to make suggestions about other products or services that you might be interested in viewing; and

  • (d) we track whether certain types of promotional e-mails were opened by you and whether you sought information about a particular product or service in order to make inferences about other products and services you might be interested in.

In addition, if you create an account, we will use your purchase history with us and our affiliates to show you inventory based on your purchasing characteristics. This means that you may not see offers and inventory that other visitors to our site will see. If you would prefer not to have this level of customization, you may use our guest checkout experience and not create an account.

7. Your Ad Choices: Interest-Based Advertising. Our website uses small pixel files (small images) and cookies (small text files) to keep track of your browser so that you will be recognized when you visit other websites where our third-party ad management providers may show you advertisements from us based on your visit to our website. Some of these advertisements may be customized to particular products and services that you viewed or they may be based on inferences about products and services that you might be interested in. This is called “interest-based advertising”.

We use essential cookies (necessary for site function), analytics cookies (to understand usage), and optional marketing cookies. You can manage preferences via the cookie banner or your browser settings.

These pixel files and cookies are generally valid for a limited number of days (usually no more than 90 days) and are provided by our ad management providers. We require our ad management providers to participate in the Digital Advertising Alliance of Canada’s Ad Choices Program. Visit the Digital Advertising Alliance of Canada: Your AdChoices website (youradchoices.ca) where you can find out more information about digital advertising and how you can opt-out of interest-based advertising. You can also opt-out of interest-based advertising using the link provided in any of our interest-based advertisements. Look for the Ad Choices icon or other link provided.

Please note that if you opt-out of interest-based advertising you may still see advertisements from us on other websites. However, they will not be customized based on your browsing history on our website. In addition, we will continue to customize our offers of products and services to you when you are on our website unless you block cookies from our website. If you block cookies on our website, certain functions, such as the “shopping cart” will not function properly because our website must recognize you as you move through the checkout process.

8. Regarding Children and Minors. Our website and the services offered on our website are not directed to children under the age of 18 years. We will not knowingly collect personal information about a child under the age of 18.

We do not allow minors (persons who are under the age of majority in their place of residence) to create accounts, make purchases or enter contests or promotions.

9. Do We Disclose Your Personal Information to Others? We may share your personal information with our service providers that help us with our business operations. For example, we will share information about your shipping address with companies that provide shipping services to us. We share information with service providers who provide us with marketing and promotional services. We require our service providers to keep your personal information secure. In addition, our service providers may not use or disclose personal information for any purpose other than providing the services on our behalf unless we or they have obtained your consent.

We may transfer any information we have about you in connection with a merger or sale (including transfers made as part of insolvency or bankruptcy proceedings) involving all or part of our business or as part of a corporate reorganization or stock sale or other change in corporate control.

We may also disclose your personal information if it is necessary for us to collect a debt from you or where we have reason to believe that it is relevant to the investigation or decision to investigate a breach of the laws of Canada, a province or territory of Canada, or a foreign jurisdiction, and we are legally permitted to do so.

10. Law Enforcement Requests. We will disclose personal information without your knowledge or consent if we receive an order, subpoena, warrant or other legal requirement issued by a court, tribunal, regulator or other person with jurisdiction to compel disclosure of your personal information.

11. Storage Outside of Canada. Your personal information may be used or stored by us or our service providers outside of Canada. We require that our service providers safeguard your personal information. However, if your personal information is used or stored outside of Canada, it will also be subject to the laws of the country in which it is used or stored.

When data is processed outside Canada (e.g., in the U.S.A.), we require equivalent contractual safeguards such as Standard Contractual Clauses or verification based on adequacy decisions.

12. Preference Centre. If you register for an account, you will have the option to choose what marketing and promotional e-mails and communications you receive from us. You can also store information such as your home and shipping address and credit card information in order to make future purchases faster. You will also be able to review your order history, past product reviews and track shipments.

You can modify your information by logging into your account and making the requested changes. You cannot modify a product review once it has been submitted. However, you can delete your product review.

You may also choose “close my account” and we will remove your account information from active use. Any product reviews will be listed as from a “former user”.

If you do not re-activate your account within 3 months, we will permanently delete your account. You may also contact us by one of the means set out in “About Us” to make a deletion request. Please note that we still maintain information that you provided to us for audit purposes or to comply with our legal obligations. We may also de-identify your information in order to continue to use it for research and analytics purposes to understand our business, to make product improvements and to make available to third parties. We prohibit our employees and third parties from attempting to re-identify information that we have de-identified.

13. How Do You Access and Modify Your Personal Information or Make a Complaint? If you have an account, log in to access and to modify the personal information stored with your account. If you have questions or concerns about other personal information collected by us and would like assistance accessing that information, please contact our Chief Privacy Officer at privacy@sheerrweather.ca.

14. How Do We Protect Your Personal Information? We take administrative, technical and physical measures to safeguard your personal information against unauthorized access, unauthorized disclosure, theft and misuse. This includes limiting access of employees to, and the use of, your personal information through the use of passwords and graduated levels of clearance. We do not publish all of our security measures online because this may reduce their effectiveness. We take physical precautions to ensure that the computer servers on which your personal information is stored and archived are secure and that access to such servers is protected. We educate our employees with respect to their obligations to protect your personal information.

Although we take precautions against possible breaches of our security systems, no company can fully eliminate the risks of unauthorized access to your personal information and no website is completely secure. We cannot guarantee that unauthorized access, hacking, data loss or breaches of our security systems will never occur. Accordingly, you should not transmit personal information to us using our website if you consider that information to be sensitive.

15. Links to Third-Party Websites and Social Network Plug-Ins. You may be able to access third-party websites through links available on our websites. You may also connect to social networks. These links are provided for your convenience. We do not have any control over those third-party websites and we do not provide any guarantee that the privacy practices of the hosts of those websites meet our standards. Your use of such third-party websites is at your own risk and will be governed by the privacy policies of those websites and not by this Privacy Notice. Do not transmit personal information using those websites without reading the privacy policies governing those websites.

You may create links between our website and social networking sites. If you do so, we may be able to publish updates about our products and services to your social network account through the links that you establish. You may terminate those links at any time by modifying your social network account.

If you are logged into a social networking site when visiting our page, your visit to our website will be personalized based on your social networking profile. You may change the way social networking sites and our sites interact by modifying your privacy settings in your social networking account. You can also log-out of your social networking account before visiting our website. For more information, please refer to your social networking site's privacy policy, which governs your use of these social plug-in features.

16. Notice to Persons Outside of Canada. This Privacy Notice is governed by the laws of Canada and applicable provincial laws. By submitting personal information to us, you understand that your personal information will be subject to the laws of Canada and applicable provincial laws.


Mobile App Privacy Policy

This privacy policy (“Privacy Policy”) applies to the Sheerr Weather mobile application (“App”), owned and operated by Sheerr Weather (“Sheerr Weather”, “we”, “us”, or “our”). We have created this Privacy Policy to tell you what information the App collects, how we use that information, and who we will share that information with, if at all. This Privacy Policy does not address the privacy practices of any third parties that we do not own, control or are affiliated with. Capitalized terms not defined in this Privacy Policy will have the meaning set forth in our Terms of Use. By visiting and/or using our App, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Use. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions.

1. Information We Collect or Receive

In the course of operating the App, we will collect and/or receive the following types of information that are necessary to provide you with access to and the services offered through the App. You authorize us to collect and/or receive such information.

  • (a) Personal Information. We only receive or collect information that identifies you personally if you choose to provide such personally identifiable information to us via e-mail or other means. When you sign up to become a user or contact us, you will be required to provide us with personal information about yourself (collectively, the “Personal Information”). Such Personal Information may include your name, e-mail address, physical mailing and billing address, phone number, username or handle, and password or security credentials. We do not collect any Personal Information from you when you use the App unless you provide us with the Personal Information voluntarily.

  • (b) Payment Information. If you choose to make a purchase or subscribe to a feature or service of ours that requires a fee, you will be required to provide us with your payment information, including, without limitation, bank account numbers, credit card or debit card numbers, account details, automated clearing house (“ACH”) information and similar data (collectively, “Payment Information”). Such Payment Information will be collected and processed by our third-party payment vendors pursuant to the terms and conditions of their privacy policies and terms of use, and we do not obtain access to any Payment Information in connection with such purchases or subscriptions.

  • (c) Geolocational Information. The App and its services are intended for users in Canada. We do not guarantee service availability elsewhere and may restrict access based on your location. Certain features and functionalities of the App are based on your location. To provide these features and functionalities while you are using your mobile device, we may, with your consent, automatically collect geolocational information from your mobile device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”). Collection of such Geolocational Information occurs only when the App is running on your device. You may decline to allow us to collect such Geolocational Information, in which case we will not be able to provide certain features or functionalities to you.

  • (d) Third-Party Analytics. We and the third-party technology providers, ad exchanges, ad networks, advertisers, agencies and ad servers with which we work use third-party analytics services (e.g., Google Analytics) to evaluate your use of the App, compile reports on activity, collect demographic data, analyze performance metrics, and collect and evaluate other information relating to the App and mobile and Internet usage. We do this to improve the App and to help us offer you new features and service. These third parties use cookies and other technologies to help analyze and provide us with the data. You consent to the processing of data about you by these analytics providers in the manner and for the purposes set out in this Privacy Policy. Please be advised that if you opt out of any such service, you may not be able to use the full functionality of the App.

  • (e) Other Information. In addition to the Personal Information, Payment Information and Geolocational Information, we may automatically collect or receive additional information regarding you and your use of the App; your interactions with us and our advertising; and information regarding your computer and mobile devices used to access the App (collectively, the “Other Information”). Such Other Information may include

    • (i) From You. Additional information about yourself that you voluntarily provide to us, such as your gender and your product and service preferences.

    • (ii) From Your Activity. We may collect or receive information regarding:

      • IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or mobile device;

      • browser type and language;

      • referring and exit pages and URLs;

      • date and time; and

      • details regarding your activity on the App, such as search queries and other performance and usage data.

    • (iii) About Your Mobile Device. We may collect or receive information regarding:

      • type of mobile device;

      • advertising identifier (“IDFA” or “AdID”);

      • operating system and version (e.g., iOS, Android or Windows);

      • carrier; and

      • network type (WiFi, 3G, 4G, LTE).

    • (iv) From Cookies. We may use both session cookies, which expire once you close the App, and persistent cookies, which stay on your mobile device until you delete them and other technologies to help us collect data and to enhance your experience with the App. Cookies are small text files an app can use to recognize a repeat visitor to the app. We may use cookies for various purposes, including to:

      • determine type of mobile device;

      • personalize your experience;

      • analyze which portions of the App are visited and used most frequently; and

      • measure and optimize advertising and promotional effectiveness.

      If you do not want us to deploy cookies in the App, you can opt out by setting your mobile device to reject cookies. You may still use the App if you choose to disable cookies, although your ability to use some of the features may be affected.

The above-mentioned categories of information may remain archived per legal obligations or for record-keeping only for as long as necessary for the purposes for which it was collected and as permitted by law.

If you choose to submit User Content (e.g., photos, videos, comments) through the App, that content may be stored and used in accordance with our Terms of Use, including promotional or operational use. Such content may be shared or published publicly.

2. Information Collected by or through Third-Party Advertising Companies

We may share Other Information about your activity on the App with third parties for ad distribution and ad optimization (defined as the tailoring, targeting, i.e., behavioural, contextual, retargeting, analyzing, managing, reporting and optimizing of ads). These third parties may use cookies, pixel tags (also called web beacons or clear gifs), and/or other technologies to collect Other Information for such purposes. Pixel tags enable us and these third-party advertising companies to recognize a browser’s cookie when a browser visits the site on which the pixel tag is located in order to learn which advertisement brings a user to a given site. In addition, we may receive Other Information from advertisers and/or their service providers such as advertising identifiers, IP addresses and post-conversion data.

3. How to Opt Out of Third-Party Interest-Based Advertising

If you wish to opt out of third-party interest-based advertising, please visit the Network Advertising Initiative (https://thenai.org) and YourAdChoices (https://youradchoices.com) websites for details on how to do so. Additionally, users of mobile devices can follow the below instructions:

Android Users

Open your Google Settings app; Select Ads; Enable “Opt out of interest-based advertising”.

iOS Users

Go to your Settings; Select Privacy; Select Advertising; Enable the “Limit Ad Track” setting.

4. How Information is Used and Shared

  • (a) You authorize us to use the Personal Information, Payment Information, Geolocational Information and the Other Information (collectively, the “Information”) to:

    • (i) provide and improve our App;

    • (ii) provide our services;

    • (iii) administer our promotional programs;

    • (iv) solicit your feedback; and

    • (v) inform you about our products and services.

  • (b) In order to provide our services and administer our promotional programs, we may share the Information with our third-party promotional and marketing partners, including, without limitation, businesses participating in our various programs.

  • (c) We engage third-party companies and individuals to perform functions on our behalf. Examples may include providing technical assistance, customer service, marketing assistance and administration of promotional programs. These other companies will have access to the Information only as necessary to perform their functions and to the extent permitted by law.

  • (d) As part of our ongoing effort to better understand our users, the App, and our products and services, we may analyze certain Information in anonymized and aggregate form to operate, maintain, manage and improve the App and/or such products and services. This aggregate information does not identify you personally. We may share and/or license this aggregate data with our affiliates, agents, business and promotional partners, and other third parties. We may also disclose aggregated user statistics to describe the App and these products and services to current and prospective business partners and investors and to other third parties for other lawful purposes.

  • (e) We may share some or all of your Information with any of our parent companies, subsidiaries, joint ventures or other companies under common control with us.

  • (f) As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution or similar event, the Information may be part of the transferred assets.

  • (g) To the extent permitted by law, we may also disclose the Information:

    • (i) when required by law, court order, or other government or law enforcement authority or regulatory agency; or

    • (ii) whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of us or others, including you.

5. Accessing and Modifying Information and Communication Preferences

If you have provided us with any Personal Information, you may access, remove, review and/or make changes to the same by contacting us as explained below. In addition, you may manage your receipt of marketing and non-

transactional communications by clicking on the “unsubscribe” link located on the bottom of any of our marketing e-mails. We will use commercially reasonable efforts to process such requests in a timely manner. You should be aware, however, that it is not always possible to completely remove or modify information in our subscription databases. You cannot opt out of receiving transactional e-mails related to the App (e.g., requests for support).

We may also deliver notifications to your mobile device (e.g., push notifications). You can disable these notifications by deleting the relevant service or by changing the settings on your mobile device.

6. How We Protect Your Information

We take commercially reasonable steps to protect the Information from loss, misuse and unauthorized access, disclosure, alteration or destruction. You acknowledge and understand, however, that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.

7. Important Notices to Non-Canadian Residents

The App and its servers are operated in Canada. If you are located outside of Canada, please be aware that your Information, including your Persona Information, may be transferred to, processed, maintained and used on computers, servers and systems located outside of your province, country or other governmental jurisdiction where the privacy laws may not be as protective as those in your jurisdiction. If you are located outside of Canada and choose to use the App, you hereby irrevocably and unconditionally consent to such transfer, processing and use in Canada and elsewhere.

8. App Stores; External Websites

Your app store (e.g., Apple App Store or Google Play) may collect certain information in connection with your use of the App, such as Personal Information, Payment Information, Geolocational Information and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.

The App may contain links to third-party websites. We have no control over the privacy practices or the content of these websites. As such, we are not responsible for the content or the privacy policies of those third-party websites. You should check the applicable third-party privacy policy and terms of use when visiting any other websites.

9. Changes to This Privacy Policy

This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. Any such changes will be posted on the App. By accessing the App after we make any such changes to this Privacy Policy, you are deemed to have accepted such changes. Please be aware that, to the extent permitted by applicable law, our use of the Information is governed by the Privacy Policy in effect at the time we collect the Information. Please refer back to this Privacy Policy on a regular basis.
